TERMS AND CONDITIONS
The User hereby agrees to be bound by the following terms and conditions
"Agreement" Shall mean and include the completed and submitted application form along with attachment(s) ,if any, as per the terms and conditions stated in the application or herein. It shall deemed to have been executed at Nagpur. These terms constitute a legally binding agreement between you and YASHOM PROPERTIES DOT COM PRIVATE LIMITED (hereinafter referred as "Company") regarding your use of the web site i.e. reraproperty.com and any of the services offered by the Company. By accessing the Website or Service, and/or by clicking "I agree" button on the website, you unconditionally agree to be bound by these Terms and conditions. You hereby represent and warrant to the Company that you are competent to contract under Indian Contracts Act 1872.
"Company" is defined as the company “YASHOM PROPERTIES DOT COM PRIVATE LIMITED”, an existing Company incorporated and registered under the Companies Act, 2013 and having its corporate office 4/4, EWS Quarter, Ridge Road, V.H.B. Colony, Nagpur, Maharashtra, India, 440027, along with its unit for the Company's website reraproperty.com.
"Services": Means the Services that are provided by the Company to the User of reraproperty.com and shall include the provision of Service to the Users wishing to post their profile or listing for the purpose of sale of their property, and for providing any other property services including any other tasks related thereto.
"reraproperty.com": is defined as the Internet Website of the Company at https://reraproperty.com hereinafter referred to as Website
"User": is defined as an individual or corporate subscriber for the Services and the signatory, whose particulars are provided by them and are contained in the online/offline application/registration form and includes his successors and permitted assignee. The Users may be of three types :
- RERA approved Builder and/or Developer;
- RERA approved Broker; &
- Buyer / Customer who is interested in buying any of the properties of the registered builders or developers with the company.
"Subscriptions" means, refers and contains time to time information and description of the Services opted and availed by the User provided by the Company in writing or contained in the website of the Company Website “reraproperty.com”.
"Subscriptions Fees" shall mean and include the charges and fees as may be prescribed by the Company to the User for the subscription for a specific period of time.
"Commission Fees" shall mean and include the charges and fees as may be prescribed by the Company to the User for the transactions of sale or other service transaction ( e.g. Advocate Fees, Architect Fees etc.) arising out of the relations created among Users through Company Website “reraproperty.com”.
“Transaction” means the transactions of Sale, Purchase, or any other related agreements arising out of the relations created from the Services on the Website of the Company.
TERMS AND CONDITIONS
- The Service shall be deemed to be commenced from date of submission of the completed online/offline Application/Registration Form on the Website.
- The Subscription Fees shall be payable at the prescribed rate within such time as stated in the communication issued by the Company to the User. Initially at the launch of the Website, the Subscription Fees are zero and the listing service is free. The Company will notify the schedule of such fees and date from which the Subscription Fees will be payable on the Website.
- The Commission Fees at the prescribed rate shall be payable at the time of Sale or Other Transaction or within such time as stated in the communication issued by the Company to the User.
- The Company shall reserve the exclusive right to cancel any content whatsoever from being published or reflected on its website or in any other mode in case of non observance or violation of any of the terms and conditions by the User.
- The property which is intended to be listed on the Website of the Company by the user of the Services of the Company shall mandatorily be approved by Real Estate Regulatory Authority (RERA) established by the Government of India by RERA Act 2016.
- The User shall be solely responsible for the accuracy of the Registration Data given to the Company on application form. The Company has a right to verify the Registration Data if it thinks or ask the User to provide additional documents for verification by the Company. The Company does not accept any responsibility towards the correctness of the data entered on the Website. The user who has entered the data on the Website is fully and solely responsible for any wrong data entered and shall be liable for any civil/criminal action taken by the third party. The User will indemnify YASHOM PROPERTIES DOT COM PRIVATE LIMITED for any action or claim made by any third party resulting from any wrong or misleading information posted on the Website by the user and/or anybody else on his behalf.
- Before entering into sale or any other agreement, all the parties to the agreement shall verify the authenticity and correctness of the information available on the Website from their lawyers or concerned experts. The Company shall not be responsible or liable for any mistake of commission or omission, or correctness of the information of the User on the Website.
- The Company however will weed out all wrong data / false data entered and will withdraw all such data within reasonable time on receiving the complaint against the User or the data entered by him on the Website. The complaint should be addressed by email at firstname.lastname@example.org with full details about the mistake or falsity of data and with full name, address, identification and mobile number of the complainant. Anonymous complaints received by any mode of communication shall not be entertained.
- The User agrees to obtain the necessary licenses, permissions, consents, approvals and intellectual property right from the concerned authorities as may be required for using the Service at his own cost. The User understands and agrees that User is responsible for all applicable taxes and for all costs that are incurred in using the service of the Company or its Website.
- The User shall keep confidential and not disclose to any person the User's password, identification, activities and transmission of information performed by the User through his user identification on the Website of the Company. The User shall immediately notify the Company of any unauthorized use of the User's account or any other breach of security immediately and instantly on the knowledge of such usage or breach to the Company or to the authorized official of the Company in this behalf.
- The User is permitted to use the services for himself for sole purpose mentioned in the online/offline application/registration form and is restrained from allowing the services to be used by any other person or make any unauthorized, illegal, unlawful or commercial use of the services.
- User agrees not to make any use of other User’s Information other than as necessary to complete the transactions in which the User is involved.
- The User is permitted to use the Website to avail the services mentioned by him in the Application/Registration Form and for no other purpose.
- All disputes arising out of or in any way connected with this agreement shall be deemed to have arisen in Nagpur (Maharashtra, India)and only courts in Nagpur shall have jurisdiction to determine the same.
- The User agrees that he shall not host, display, upload, modify, publish, transmit, update or share any information on the Website that belongs to another person, causes damage to other person’s legal rights, and infringes any intellectual and other property rights, threatens the unity, integrity, defence, security or sovereignty of India or otherwise unlawful in any manner whatsoever.
- The Company may at its sole discretion and without assigning any reason whatsoever at any time deactivate or/and suspend the User's access to the Website or the Services without notice to carry out system maintenance and the related work.
